Suno Loses Copyright Case in Germany

A German court ruled against AI music startup Suno in a copyright lawsuit filed by music rights organization GEMA. The Munich Regional Court found that Suno violated copyright law by using music from GEMA's catalog to train its AI models and reproducing protected works without a license. The ruling mandates that AI companies obtain licenses for the commercial use of GEMA's repertoire, which includes both AI model training and music generation. The lawsuit involved six songs, including 'Daddy Cool,' 'Rasputin,' 'Forever Young,' and 'Mambo No. 5.' GEMA accused Suno of training its AI on copyrighted songs without permission. Suno stated that its platform is designed to help users create new music rather than reproduce existing songs. The company claims the ruling stems from a misunderstanding of its technology and is considering legal options, including an appeal. This decision follows GEMA's previous victory against OpenAI, where a Munich court ruled that ChatGPT unlawfully reproduced copyrighted song lyrics. Additionally, Suno is under increasing legal scrutiny regarding its AI model development, with leaked source code revealing that its training data included over 113000 hours from YouTube Music, 62000 hours from Pond5, and 12000 hours from Deezer, reinforcing claims that it trained its AI on copyrighted recordings without permission.
